Adult Release of Liability, Wavier of Claims, Assumption of Risk and Indemnity

    
Town of Banff and its respective elected officials, officers, directors, employees, volunteers, partners, and contractors (collectively referred to as the “Releasees”).

ASSUMPTION OF RISKS

I, the undersigned, in consideration of my participation in this SSBV Try It Sports Program, which includes all of the programs - current and future listed HERE at any point, on or after the date of my signature below, offered by the Town of Banff at any location, I hereby accept that I will be engaging in the voluntary activity and that the activity itself and the use of exercise equipment has inherent risks associated, which include but are not limited to: slips, trips and falls, cuts, abrasions, steep terrain, falling debris such as rocks, trees, or other objects, weather, heatstroke and sunburn, wildlife, remote locations, hypothermia, frostbite, failure of equipment, limb/finger sprains/breaks, bruises, transportation, infectious diseases transmitted through direct or indirect contact, negligence of other persons and NEGLIGENCE ON THE PART OF THE RELEASEES, death, property damage, or any other loss. I understand that it is my responsibility to learn about and understand the risks, dangers, and hazards of participating in the activities related to the SSBV Try It Sports Program and accept the risks associated with my participation.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the releasees allowing me to participate in “SSBV Try It Sports Program” which include all activities, services, use of facilities, programs, orientations and instructional sessions, classes and clinics, events and other activities offered by the Releasees, I hereby agree as follows:

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any property damage, loss, or personal injury to any third party resulting from my participation in this SSBV Try It Sports Program.

3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity;

4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of Alberta and no other jurisdiction;

5. Any litigation involving the parties to this Release Agreement shall be brought solely within Alberta and shall be within the exclusive jurisdiction of the Courts of Alberta; and 

6. If any provision of this Release Agreement is held by a Court to be unenforceable, then such provision will be modified to reflect the Participant and Releasees’ intention. All remaining provisions of this Release Agreement shall remain in full force and effect as drafted.

In entering into this release, I am not relying on oral or written representations or statements made by the Town of Banff, its agents, or its employees to induce me to participate in this SSBV Try It Sports Program.

This personal information is being collected under the authority of the Freedom of Information and Protection of Privacy (FOIP) Act, Section 33(c). This information will be used in the administration of this program.
