Terms of Use
Preamble
Stade IGA is a non-profit organization whose mission is to promote the recreational practice of tennis. Stade IGA is also a high-level national training center, a development and competition center, a certification center for coaches, trainers, and referees, a publicly accessible tennis facility, and a multifunctional center.
The Terms of Use of Stade IGA and their application aim to promote the use of Stade IGA facilities in a safe manner and in compliance with its mission, its agreement with the City of Montreal, its obligations towards its partners, its Users, its Staff, and its facilities.
The Terms of Use apply to any person who accesses Stade IGA, including, but not limited to, public Users, athletes participating in a training program, coaching staff, partners, and tenants.
The User of Stade IGA agrees to comply with the Terms of Use currently in force and those that will be enacted in the future.
Definitions
"User": any person within the Stade IGA area except for Staff members*.
"Staff": any person employed by or mandated by Stade IGA.
"Stade IGA": the legal name of Tennis Canada – Stade Jarry, located at 285, rue Gary-Carter, H2R 2W1, Montreal (QC).
*As part of its mission to develop tennis, Stade IGA grants certain exemptions to athlete Users and certified training Staff recognized by our partners such as Tennis Montréal, Tennis Québec, or the Tennis Canada National Training Center.
Sanctions
A User who violates the Terms of Use of Stade IGA or a law may be subject to one or more sanctions. In this regard, Stade IGA reserves the right to impose sanctions without appeal in cases of serious violations of the regulations, including behaviors endangering the safety or integrity of the facilities.
The severity of the sanctions is determined based on the significance of the violation or its recurrence.
The sanctions imposed may take the form of a verbal or written warning, a temporary restriction of access to Stade IGA, an immediate expulsion, a temporary expulsion, or a permanent expulsion.
Any request for a sanction review must be submitted in writing and will be examined at the sole discretion of Stade IGA management.
Recommendations
Stade IGA and its Staff are not responsible for damage, loss, or theft of Users' personal belongings inside or outside Stade IGA. It is recommended to leave valuable personal items at home.
Users are advised to undergo an annual medical examination before using the facilities. Any person with specific health conditions is responsible for their condition and medical follow-up. It is recommended to inform the Stade IGA reception team.
Responsibility
The User agrees to use the facilities of Stade IGA at their own risk. Users are entirely responsible for any damage caused to equipment or facilities and must reimburse the repair or replacement costs.
The User acknowledges that they are responsible for obtaining the necessary information and inquiring with the Staff on how to use the equipment safely and appropriately.
In the event of an emergency or force majeure, Stade IGA prioritizes the safety of its facilities and Users and may restrict access without any obligation of reimbursement.
Regulations Governing the Facilities
Civility
Any person accessing Stade IGA must comply with the laws in force and maintain respectful behavior towards other Users and Staff. Any act of a sexual, fraudulent nature, theft, physical or verbal assault against another User or a Staff member may result in immediate and permanent expulsion from Stade IGA. Finally, Stade IGA fully cooperates with the competent authorities in case of violations.
Access
Every User has the obligation to be aware of the Terms of Use before accessing the Stade IGA facilities.
Access to Stade IGA facilities is only possible for Users with an account on the booking platform and having a paid reservation for a tennis court, for adults accompanying a User under 12 years old, for Stade IGA Staff, as well as for its tenants and partners.
Stade IGA may restrict or deny access to any person deemed harmful to security or the proper functioning of the facilities. Inspections or searches of personal belongings are authorized to ensure compliance with regulations and the security of the premises.
Every User must respect the check-in procedure before accessing the courts by reporting their presence at the reception, registering the name of their playing partners if applicable, and scanning the code linked to their member profile at the entrance turnstiles.
Every user accepts to have their picture taken to be linked to their member profile for identification purposes.
Stade IGA reserves the right to terminate or modify one, several, or all of its services as needed, particularly for renovation, repair, maintenance, or other cases of force majeure, without any compensatory indemnity being claimed. The management may adapt the use of spaces (courts, locker rooms, lounge) according to organizational needs or for special events.
Any User under 12 years old must be accompanied by an adult in charge or supervised by a program recognized by Stade IGA. The accompanying person must access the facilities through reception, and their access is limited to the lounge area, the indoor bleachers, the restrooms, the shop, and, if the User is 5 years old or younger, the locker rooms corresponding to the adult's gender.
For Users with a tennis court reservation or participating in a program recognized by Stade IGA, access includes the lounge area, including restrooms, indoor bleachers, and the shop; the hallway leading to the locker rooms; the locker rooms; the central hallway of the section with 11 tennis courts; the staircase and elevator leading to the clay courts for players who have obtained access confirmation from reception; the tennis court confirmed by reception.
Prohibitions
Inside Stade IGA, as well as on the outdoor courts, it is strictly prohibited to bring animals, except for assistance and guide dogs. For security reasons, Stade IGA Staff may require the dog owner to provide the necessary documents certifying the dog as an assistance or guide dog.
It is also prohibited to bring skates, scooters, skateboards, and bicycles, weapons or dangerous objects, alcohol and drugs, any advertising or promotional material not previously authorized by Stade IGA Staff, any merchandise intended for sale not previously authorized by the Stade IGA team, or any material that may serve for a demonstration, regardless of the cause.
Respect for Facilities
Alcohol and Drugs
Any User in a state of intoxication or under the influence of drugs may be denied access or expelled.
Commercial Exclusivity Clause
Commercial activities or external partnerships within the facilities must receive prior written approval. Any unauthorized activity will result in immediate sanctions, including expulsion.
Facility Integrity
Users are prohibited from degrading, misusing, or damaging any Stade IGA facility under the risk of facing legal action. If damage occurs, whether intentional or not, it must be reported to reception, and the User may be held responsible for the cost of repairs or replacement of equipment.
Play
It is forbidden to play tennis in areas other than tennis courts and outdoor hitting walls. The practice of any other sport, such as soccer or street hockey, is prohibited in all areas of Stade IGA unless authorized by the Staff.
Walking and Running
Running inside the indoor center is prohibited except on tennis courts.
Nudity
Nudity, including a bare torso, is only permitted inside the locker rooms while changing or showering, and it is also prohibited on outdoor courts.
Promotion and Distribution of Advertising or Informative Materials
It is forbidden to distribute any promotional or informational material without the authorization of Stade IGA management. This includes the distribution of accessories, promotional gifts, as well as leaflets, brochures, and publications not previously approved by Stade IGA.
It is also forbidden to attempt to create an unauthorized brand affinity or presence by any means. The use of Stade IGA’s name, logo, or image for commercial or advertising purposes is strictly reserved for Stade IGA and its authorized partners.
Cleanliness
The use of trash bins, recycling bins, and compost bins is mandatory.
Quietness
Every User must respect the neighborhood and other Users of Stade IGA in maintaining the peacefulness of the premises.
Security
Stade IGA reserves the right to conduct a summary search of any person entering its facilities and/or use a metal detector.
Solicitation
It is forbidden to solicit Users to offer them products or services other than those provided on-site by Stade IGA or one of its tenants.
Sales
It is forbidden to sell items or possess items within Stade IGA for the purpose of selling them without authorization.
Video Surveillance
Any User accessing the facilities consents to being subject to video surveillance. The data collected by Stade IGA (including video surveillance) is exclusively used to ensure security, operational management, and compliance with regulations. Stade IGA reserves the right to retain this data for a reasonable period to investigate incidents or comply with the law.
Regulations for Tennis Players
Reservation Transfer
A User may not transfer their reservation to another User.
Arrival
The User must report to the reception desk to complete the check-in procedure before accessing the court confirmed by reception. The User may enter the area beyond reception a maximum of one (1) hour before the time of their reservation.
End of Play and Court Release
Each User completing their playing time must vacate the court at the precise hour to allow the next reserved Users to start on time. It is the User’s responsibility to organize their time to collect their sports equipment (including balls) to vacate the court on time. This time is included in the scheduled playing hour.
Users on clay courts must sweep the court with the drag net before the end of their playing time to restore it to its proper condition. The User must account for this time before their hour of play ends, as well as time to collect their sports equipment and balls.
If playtime ends and no other User arrives on the court, it is possible to continue playing provided that authorization is obtained from Stade IGA reception. The User will be charged for an additional (1) hour of rental according to the applicable rates.
Maximum Daily Presence on a Court
A maximum of two (2) hours play per day is permitted at IGA Stadium when the outdoor courts are open. A maximum of one (1) hour of play per day is permitted when the outdoor courts are closed for the winter season. This limit applies whether or not the court has been reserved in the User's name.
If the maximum number of hours has been reached and courts are still available, the User may be authorized by reception Staff to play an additional hour, provided they check in and pay for the court before benefiting from the additional playing hour (referred to as "walk-on").
Court Change
It is forbidden to use a court other than the one confirmed by reception without explicit authorization from the latter.
Locker Rooms
It is forbidden to change anywhere other than in the locker rooms.
Each User must use the locker room corresponding to their gender, except for children aged five (5) and under. Children aged one (1) to five (5), regardless of gender, may go into the locker room corresponding to their responsible adult’s gender.
Because cell phones have many functionalities, Stade IGA prohibits the use of cell phones in locker rooms to preserve the privacy of its Users and maintain a peaceful environment.
Each person is entirely responsible for their belongings and personal effects.
If a User forgets the combination to their locker containing their belongings, they may request assistance from the reception Staff.
It is forbidden to appropriate and leave a locker locked outside of playing hours. A grace period of thirty (30) minutes is allowed. Lockers left locked beyond this period may be emptied.
After use, each locker must be completely emptied, clean, and unlocked.
Lost and found items will be stored with lost belongings and may be claimed at the Stade IGA reception. At the end of each month, unclaimed items are donated to charity.
Dress Code
Appropriate attire for playing tennis is mandatory.
In winter, all individuals must leave their boots on the designated shelves in the lounge area.
Number of Users per Court
A maximum of four (4) Users per court is allowed.
List of Prohibited Items on Courts
The following are prohibited on all types of courts: chewing gum, food, any glass container.
In general, food, beverages (except water bottles and sports drinks with electrolytes), boots, coats, backpacks, and any other item not necessary for playing a sport are prohibited on tennis courts and must remain in the locker rooms.
The occasional use of phones and tablets is allowed in the tennis court area, provided the devices do not disturb the enjoyment of the facility for other Users. Ringtones and all sounds must be turned off (silent mode, vibration allowed).
User Registration Policy
All players must register in the Stade IGA reservation system through the online booking platform, in person at reception, or by phone.
If applicable, the User must present their Accès Montréal card and, for juniors and seniors, an identification card with a photo indicating their date of birth. The User is responsible for updating their documents at the Stade IGA reception, by email, or in person. The privileges associated with Accès Montréal and the junior and senior age groups will not be granted if the required cards and documents have not been provided and validated beforehand.
Court Booking and Cancellation Policy
Reservation
Reservations can only be made through the online reservation system, in person, or by phone.
A holder of an Accès Montréal card previously registered in the Stade IGA reservation system can book up to 3 days in advance, starting at 8:30 PM by phone or on the online reservation system, or starting at 9:30 PM in person.
Example: A reservation is possible starting Monday at 8:30 PM to play on Thursday.
A holder of an Accès Montréal card aged 17 years or younger previously registered in the Stade IGA reservation system can book up to 3 days in advance, starting at 7:00 AM on the online reservation system or by phone, or starting at 8:30 AM in person.
A non-holder of an Accès Montréal card (Regular) previously registered in the Stade IGA reservation system can book up to 2 days in advance, starting at 8:30 PM on the online reservation system or by phone, or starting at 9:30 PM in person.
Payment
Payment must be made at the time of booking the court.
Responsibilities of the Booking User
At all times, the User must comply with the Terms of Use. Any violation may result in warnings and/or sanctions. No exceptions or refunds will be allowed.
No reservation can be made if the User has an outstanding balance on their account.
The person responsible for the reservation is liable for the full payment of the court.
The booking User is responsible for the behavior of all Users on their court reservation.
The booking User must declare their playing partners at the time of reservation.
Even if the tennis court is available, players may not access it before the designated reservation time unless authorized by a member of the reception Staff.
Walk-On Rules
Fifteen minutes before the start of the playing hour, if a court is still not reserved for the next hour, the User may be authorized by the reception Staff to play a third hour in summer and outdoors, or a second hour in winter, provided that they check in at reception and pay the court fee before benefiting from the additional playing hour.
Court Assignment
Stade IGA cannot guarantee the court number assigned to the User. It may be modified at any time.
Number of Courts per User and Presence
The booking User may rent a maximum of one (1) court per hour. The booking User must be present on the court.
Cancellation Policy: Penalty fees and sanctions
Cancellation Deadlines
To obtain a credit for the reservation amount, a User must cancel at least 24 hours in advance. Within the 24-hour window, a credit equivalent to 50% of the rental fees may be applied to the User’s account.
In the case of a no-show (the booking User does not show up and has not canceled their reservation), no credit or refund will be given.
Stade IGA reserves the right to apply any other sanction following a violation of the cancellation deadline rule.
Stade IGA may modify or cancel reservations for operational reasons without being held responsible for any inconvenience suffered by Users.
Court Pricing
The pricing for indoor and outdoor hard courts, as well as clay courts, varies depending on the time of year. Pricing may also vary based on the type of Users.
Interruption and Resumption of Play Policy in Case of Rain
For any weather conditions making outdoor tennis play dangerous (including rain), the game may be interrupted by the reception Staff.
For outdoor courts, game interruption and resumption are exclusively determined and communicated by the reception Staff of Stade IGA.
Any User who does not comply with the game interruption decision is in violation of the Regulations and may receive a warning leading to a suspension of their rights.
The decision to resume play is made no later than 15 minutes before the start of the new playing hour.
Credit Refund Policy
In certain situations requiring the cancellation of a reservation, the Staff may issue a refund in the form of credit to the booking User’s account. These situations include:
· Emergency maintenance
· Any other unforeseen circumstances recognized by Stade IGA
· In case of rain for outdoor courts:
If the interruption occurs before the halfway point (30 minutes) of the playing hour, a full refund of the rental fee is granted in the form of credit to the User’s account. If the interruption occurs after the halfway point (more than 30 minutes) of the playing hour, no refund will be given.
Under no circumstances are valid credits at Stade IGA refundable.
Policy on the Revision of Terms of Use and the Court Rental Policy, Reservation Terms and Cancellation Policy
Stade IGA reserves the right to revise its regulations annually to ensure their legal compliance and alignment with operational needs.
Commitment to Comply with the Terms of Stade IGA
By accessing the facilities of Stade IGA, each User acknowledges having read the Terms of Use and the Court Rental Policy, Reservation Terms, and Cancellation Policy in effect, agrees to comply with them at all times, and accepts that any violation may result in disciplinary measures, including temporary or permanent expulsion from Stade IGA.
These regulations and policies aim to ensure a safe, respectful, and enjoyable environment for all. They cover the use of courts, player behavior, compliance with schedules, and the safety and maintenance guidelines for the facilities.
Any registration, reservation, or use of the facilities constitutes full and unconditional acceptance of these regulations.
