Rivers Edge Camp and Retreat Centre -Participant Activity Waiver and Release of Liability
I, the participant, on behalf of myself, my heirs, next of kin, spouse and assigns, hereby waive any claims and release Rivers Edge Camp and Retreat Centre (herein called "Rivers Edge") and its Directors, agents, representatives, employees and any other person or organization assisting in all camp activities from any claims for damages or injuries suffered as a result of my participation in such camp activities or travelling to or from such camp activities. I further state that to the best of my knowledge, I am in the proper physical condition to participate in such camp activities, and I am aware that my participation could, in some circumstances, result in physical injury or death.
Equine services are provided by our Equine Coordinator, K. Bosomworth, or by another qualified personnel.
These camp activities and associated risks include, but are not limited to:
Bubble Soccer: Risks include collisions, falls, sprains, strains, and other physical injuries. Archery: Risks include misfires, injuries from arrows, and potential eye injuries.
High Ropes Course: Risks include falls, equipment malfunction, and injuries resulting from heights.
Wall Climbing: Risks include falls, injuries from climbing holds, and equipment malfunction. Equine Activities - Risks include falls from the animal, being kicked or bitten by the animal, and other injuries.
BMX: Risks include falls, collisions, injuries from bike malfunction, and injuries from jumps and tricks.
Hiking to the River: Risks include slips, trips, falls, exposure to weather, wildlife encounters, and potential drowning.
Other Activities: Other activities at the camp also carry inherent risks that may not be specifically listed.
I HEREBY:
1. ACKNOWLEDGE that my participation in these activities involves risk that may cause injury or death, because of unexpected and unanticipated events which may occur at any stage of the activities and I voluntarily assume the risk and danger of injury or death related to my participation in the activities and do not hold Rivers Edge or any of their agents liable for such injury or death.
2. RELEASE, DISCHARGE AND PROMISE NOT TO SUE Rivers Edge, its agents, or any heirs, executors, assigns, for any loss, liability, damage, or costs whatsoever arising out of or related to any loss, damage, injury, or death to myself.
3. RELEASE Rivers Edge and its agents, heirs, executors and assigns from any claim that Rivers Edge, or any of its agents, are or may be negligent in connection with my participation including, but not limited to, the activities and associated inherent risks listed above.
4. INDEMNIFY, SAVE AND HOLD HARMLESS Rivers Edge, its agents, heirs, executors and assigns from and against: (i) any loss, liability, damage or cost that may be incurred arising out of or in any way connected with my participation in, but not limited to, the above noted activities or any acts or omissions by Rivers Edge or any of its agents; (ii) any legal fees and costs arising out of or in any way connected to any manner, act, any legal fees, and costs arising out of or in any way connected to any manner of actions, causes of action, suits, claims and demands in relation to or arising out of or in any way connected with my participation preceding, during or following the activities.
5. UNDERSTAND that Rivers Edge is not responsible for theft, vandalism, damage or loss of personal property. Participants are responsible for their own personal property including travel to and from the activity. Rivers Edge does not provide storage for personal property, equipment or travel to or from the activity.
6. AGREE to abide by and follow any rules or instructions established by Rivers Edge or any of its agents.
7. UNDERSTAND that equine related activities include inherent risks, being those dangers or conditions which are an integral part of such activities, and shall be considered to include, but are not limited to:
The propensity of equines to behave in ways that may result in injury, harm or death to persons on or around them and/or damage to property in their vicinity.
The unpredictability of any equines' reaction to such things as sounds, sudden
movement and unfamiliar objects, persons or other animals.
The equine's response to certain hazards such as surface and subsurface objects.
Collisions with other equines, animals, people and objects.
The potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the equine or to act within his or her ability.
8. UNDERSTAND that Rivers Edge is a Christian camp. The camp's statement of faith can be found on the camp's website: (https://riversedgecamp.org/about-us/statement-of-faith/). While I may or may not agree completely with Rivers Edge statement of faith, I agree to be respectful of Rivers Edge's position, and will behave in a way that is consistent with Rivers Edge's statement of faith.
9. Give permission for Rivers Edge to contact emergency personnel in the event of an incident.
10. Give permission for the reasonable use of photos and videos of myself for any camp-related promotions.
11. Give permission for the reasonable use of my email address to keep me informed of camp-related communications.
12. Believe that my physical and emotional condition will allow me to function appropriately in participating in the activities, and that I am mentally stable. I understand that Rivers Edge does not have mental health workers present, nor the resources available should a situation arise. If a situation arises, Rivers Edge will contact emergency personnel, and the participant will be turned over to emergency personnel.
