TOB FCSS Children & Youth Programs Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity

    
Town of Banff and its respective elected officials, officers, directors, employees, volunteers, partners, and contractors (collectively referred to as the “Releasees”).

ASSUMPTION OF RISKS

I, the undersigned, in consideration of my child/ward’s participation in the TOB FCSS Children & Youth Programs, at any point on and after the date of my signature indicated below, offered by the Town of Banff at The Banff Elementary School, and the Fenlands Banff Recreation Centre, and any other location, I hereby accept that my child/ward will be engaging in activities that have inherent risks associated, which include but are not limited to: slips, trips and falls, cuts, abrasions, failure of equipment, failing to engage in activities safely or within one’s own ability, overexertion or lack of fitness, infectious diseases transmitted through direct or indirect contact, wildlife encounters, insect bites and stings, weather conditions including extreme cold or heat, rain, snow, blizzards, thunderstorms, and smoke, remote locations, campfires, unsafe actions of other facility and program users, negligence of other persons and NEGLIGENCE ON THE PART OF THE RELEASEES, death, property damage, or other loss. I understand that it is my responsibility to learn about and understand the risks, dangers, and hazards of my child’s participation in the activities related to TOB FCSS Children & Youth Programs and accept the risk associated with my child/ward’s participation.

PERMISSION TO PARTICIPATE 

In consideration of the releasees allowing my child/ward to participate in TOB FCSS Children & Youth Programs which include all activities, services, use of facilities, programs, orientations and instructional sessions, classes and clinics, events and other activities offered by the Releasees, I hereby agree as follows:

In entering this Consent and Acknowledgement of Risk Agreement, I am not relying on oral or written representations or statements made by the Town of Banff, its agents or employees with respect to the safety of TOB FCSS Children & Youth Programs other than what is outlined in the Consent and Acknowledgement of Risk Agreement.

 This personal information is being collected under the authority of the Freedom of Information and Protection of Privacy (FOIP) Act, section 33(c). This information will be used in the administration of the Town of Banff's Children & Youth Programs.
