RELEASE OF LIABILITY, WAIVER CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

IMPORTANT NOTICE: BY SIGNING THIS AGREEMENT, YOU ARE ACCEPTING RISKS AND AGREEING TO GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.  DO NOT SIGN THIS AGREEMENT UNTIL YOU HAVE READ IT, COMPLETELY UNDERSTAND IT, AND AGREE TO ALL OF ITS TERMS.

Singular and plural: In this waiver, the singular (“I”, “my”, “his”, “her”, “child”, etc.)  will also include the plural (“we”, “our”, “their”, “children”, etc.).

TO: The Glebe Neighbourhood Activities Group [hereinafter “GNAG”]

I am the parent or legal guardian having full legal responsibility for the decisions regarding my minor child (the "Participant") and I am executing this document on behalf of the Participant, and all of our heirs, executors, administrators, assigns, next of kin, and personal representatives. I understand that this Agreement shall be effective and binding upon our heirs, next of kin, executors, administrators, assigns and representatives, in the event of either of our deaths or incapacity.

Permission to Participate

I, as the parent or legal guardian of the Participant, confirm that this individual is a minor pursuant to the Age of Majority and Accountability Act, RSO 1990, c A.7, as amended, and provide permission for them to participate in the program or activity noted above. If this applies to a GNAG childcare program, I have been provided with additional Terms and Conditions applicable to said program.

Assumption of Risk and Waiver of Liability

I fully understand that the program or activity for which I have enrolled the Participant may involve personal risk, dangers, and hazards that all participants are required to assume. Understanding this, I hereby accept on behalf of the Participant all risks, dangers, and hazards as well as the possibility of personal illness, personal injury or other loss resulting from the Participant's participation in this program or activity. I agree to release, waive, and discharge GNAG and the City of Ottawa and all of its directors and officers, employees, officials, agents, and volunteers (collectively and individually the “Releasees”) from all liability to me and to the Participant, and to my heirs, executors and administrators, that we have, or may have in the future, for all loss or damage and from any claims or demands for such loss or damage on account of personal illness, personal injury, and damage including death or property loss, however caused, including without limitation, the negligence or omissions of the Releasees, as a result of the Participant's participation in this program or activity.

Indemnification

I hereby agree to indemnify and save harmless GNAG and the City of Ottawa and all of its directors and officers, employees, officials, agents, and volunteers from any and all liability for any property damage or personal illness or personal injury to any third party resulting from the Participant's participation in this program or activity.

Sunscreen Application Permission

This waiver allows for the application of sunscreen to my child. I give permission for sunscreen to be applied to my child.

Sanitizer Application Permission

This waiver allows for the application of sanitizer to my child’s hands. I give permission for sanitizer to be applied to my child’s hands.

Severability

If anything in this Agreement is found by a Court to be unenforceable, then it will be modified to reflect the parties’ intention. Everything else in this Agreement will remain in full force and effect.

By signing below, I agree with the terms of the permission to participate, the assumption of risk, the waiver of liability, and the indemnification set out above.
