You must be of legal age (18 or older) to validate this document for yourself, as well as to accept the risks for minors under your responsibility or persons accompanying you. By completing this form, you agree that you and all the aforementioned persons will collectively be designated as the “Participants.”

All activities and services offered by Espace ACTN3, including Ninja Warrior, Parkour, and any other activity, regardless of where they take place (hereinafter collectively referred to as the “Activities”), involve risks and dangers inherent in athletic and acrobatic practice that may result in serious injury or death.

Espace ACTN3 has taken all reasonable measures to provide appropriate instructions, safe facilities, and qualified coaches in order to minimize risks. However, due to the very nature of these disciplines, it is impossible to completely eliminate the risks inherent in these Activities. By taking part in these Activities, you acknowledge and accept the normal and foreseeable risks incurred by all Participants.

You also declare that all Participants are physically fit to take part and do not suffer from any medical condition, illness, disorder, or injury that could compromise their safety or that of others.

1. Acknowledgment and Acceptance of Risks

I acknowledge and accept that the Activities involve risks of injury inherent in this type of sport, including, without limitation, bruises, sprains, concussions, fractures, serious injuries, paralysis, or death. I understand that these risks are inseparable from the practice of these disciplines, regardless of where they take place, and that they may result from the actions or inactions of the Participants, environmental conditions, the nature of the equipment or facilities used, as well as any other normal factor related to assessing my own limitations. With full knowledge of the foregoing, I voluntarily accept these risks on behalf of all Participants.

2. Understanding and Strict Compliance with the Rules

I understand that it is my responsibility to ensure that the Participants strictly comply with all safety instructions issued by Espace ACTN3 staff and coaches, as well as those posted or communicated on the premises. I undertake to ensure that the Participants use the equipment appropriately, remain vigilant regarding their surroundings, and engage in activities at difficulty levels suited to their actual abilities. I acknowledge that failure to comply with these rules may increase the risks to the Participants and others and may result in immediate removal from the activity, without a refund.

3. Personal Responsibility and Medical Condition

Assuming responsibility for the safety of the Participants, I undertake to inform Espace ACTN3 staff of any medical condition, ongoing treatment, severe allergy, or particular concern regarding the health or safety of the Participants before the beginning of any Activity.

4. Limitation of Liability

To the fullest extent permitted by the laws of the Province of Quebec, I release Espace ACTN3, its officers, coaches, and staff from all liability for property damage or for inherent and foreseeable risks related to participation in the Activities, regardless of where they take place. I acknowledge that this clause applies definitively.

5. Parental Authorization (for Minors)

As an authorized signatory, parent, or legal guardian, I confirm that I have read this document and explained the risks and safety rules to all Participants covered by this form. I freely and fully consent to their participation in Espace ACTN3’s Activities.

6. Governing Law and Choice of Forum

This agreement is governed by, interpreted, and enforced in accordance with the laws applicable in the Province of Quebec. Any dispute arising from participation in the Activities or from the interpretation of this document shall be submitted exclusively to the courts of the judicial district of Montreal.

7. Severability of Clauses

If any provision of this document is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid, and the validity, legality, and enforceability of the remaining provisions shall not be affected in any way.

I confirm that I have carefully read this document, that I fully understand its terms and legal implications, and that I freely and voluntarily accept it on behalf of all Participants covered by this form.
