Cancellation Policy
Cooking Camps & Classes:
- All cancellation requests must be made via email to nutritionhealthtours@gmail.com. A full refund will be issued for cancellation requests made at least 30 days before the camp or class start date. Requests made within 30 days of the start date will be subject to a $125 late cancellation fee per class or camp session and per child cancelled. No refunds will be issued after the camp or class session has started.
- We reserve the right to refuse or dismiss any participant, temporarily or permanently, if their behaviour compromises the safety, well-being, or operation of the camp or class sessions. This includes failure to follow rules, disruptive conduct, or any threat to others. Parents/guardians are financially responsible for any damage caused by their child to others or their property. A refund will not be issued in the case of such dismissal.
- Uniforms and closed-toed shoes are mandatory for all camp and class for hygienic reasons. Participants will not be allowed to attend camp or classes without a uniform and closed-toed shoes. If a uniform needs to be provided on-site, a $40 fee will apply.
- NHT reserve the right to cancel any session that does not meet minimum enrolment requirements up to three weeks prior to the session start date. Families to be notified via email. In such cases, a full refund will be issued.
- No refunds will be offered to participants who miss any classes that they were registered for but failed to attend.
Sickness, Illness or Inclement Weather
- There are no exceptions or refunds for missed classes due to any reason, including illness, weather, family circumstances, or traffic.
- We reserve the right to deny temporarily deny admission or request early departure to camp or class session for any participant showing signs of illness or deemed unfit to participate. Return to camp or class is at our sole discretion to ensure the health and well-being of all participants and staff.
Privacy Policy
- Personal information collected and/or held by Nutrition Health Tours (“NHT”) will only be used for the purpose it was collected for and to contact you for offers related to our services.We will not disclose any personal information to third parties unless you provide explicit authorization.
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
Nutrition Health Tours (“NHT,” “we,” “us,” “our”) requires all participants and/or their parents or legal guardians (“you,” “your”) to carefully review and accept the terms and conditions of this Release of liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement (“Agreement”) before participating in any of the activities described below. By signing this Agreement, you waive certain legal rights, including the right to sue. Please read this document carefully.
In consideration of participation by you and/or your minor child in cooking camp and classes offered by Nutrition Health Tours (“Services”or “camp”or “camps” or “class” or “classes” or “session” or “sessions”), you agree to the following on behalf of yourself and/or your minor child:
1. Assumption of Risk
a) Risks:
You acknowledge and agree that (i) camp or classes involves risks of injury and illness (the “Risks”), including but not limited to cuts, burns, scalds, falls, allergic reactions, bruises, bone injuries, shortness of breath and other risks associated with preparing, cooking and consuming food, and engaging in physical activities; (ii) the Risks may be increased as a result of the fact that the camp and class are offered in group setting; and (iii) there may be risks that are not known or reasonably foreseeable at this time. You acknowledge and agree to assume all Risks and associated damages or losses which you and/or your minor child may sustain in participating in the Camp and classes, including those caused by the negligence, acts, or omissions of Nutrition Health Tours, its owner, employees, volunteers, contractors, agents and insurers.
b) Allergies:
You acknowledge and agree that you must disclose whether your minor child has any known allergies or dietary restrictions prior to the start of the Camp and classes. You acknowledge and agree that we do not guarantee an allergen-free environment and are unable to accommodate food allergies.
c) Ability to Participate:
You acknowledge and agree that participation in the camp or classes is voluntary. You acknowledge and agree that you and/or your minor child are in good health and do not have any physical, mental, or behavioural conditions that would increase the risk of injury or illness while participating in the camp or classes, except as disclosed to us. You understand that it is your responsibility to inform NHT at the time of registration of any physical, mental or behavioural concerns that may impact your minor child's ability to participate in some or all camp or classes activities. You acknowledge and agree that NHT does not currently offer camp or classes for minors who require additional supports due to physical, mental, or behavioural conditions.
Dress Code Requirements:
You acknowledge and agree that a uniform (apron and cut-resistant gloves) and closed-toe shoes are required for participation in all camps and classes. Participants without uniform and/or wearing open-toed shoes, including flip-flops or sandals, will not be permitted to participate. Loose sleeves are also not allowed. Fitted clothing must be worn to ensure safety and prevent interference with food preparation.
d) Medical: First Aid & Emergency Treatment:
You acknowledge and agree that first aid may be given to your minor child by NHT employees in attendance in the event of accident, injury or illness during cooking class and camp activities.
If applicable, in the event of an emergency, you authorize us to secure medical services as deemed necessary in the instances where all attempts to contact the parent or guardian have failed, for the health and safety of your minor child or when the nature of the emergency allows insufficient time to contact such parent or guardian. You acknowledge and agree to be responsible for the payment of any and all medical services rendered.
2. Release of Liability and Indemnity
You, for yourself, your minor child’s other legal guardians, your minor child, and on behalf of any of your and their heirs, executors, and administrators, as applicable, forever waive, release and discharge Nutrition Health Tours, its owner, employees, volunteers, contractors, agents and insurers (“Released Parties”) of and from any and all liabilities, claims, demands, damages, costs (including reasonable legal fees and costs), actions and causes of action of any kind or nature whatsoever (collectively, “Claims”) related to or arising from, whether directly or indirectly, all activities undertaken in connection with camp and classes (collectively, “Losses”). For greater clarity, Losses include, but are not limited to: (a) personal injuries or illness (including death), damages, or losses to you and/or your minor child; and (b) property damage (i) arising out of or relating to participation, whether passively or actively, in any Camp, class, or other activities on or off premise, including but not limited to use of any equipment; or (ii) occurring on the premise, including but not limited to your and/or your minor child’s use of any restroom area, common area, associated sidewalks, and parking areas. You agree not to bring any Claims against the Released Parties, whether personally or through any third party. This release will be interpreted to the fullest extent permitted by law and, if permitted by law, will apply even if any Losses are caused in whole or in part by the Released Parties’ own negligence or the negligence or willful conduct of any other patron who is on the premises or who is participating in any of the camp or classes. You, for yourself, your minor child’s other legal guardians, your minor child, and on behalf of your and their heirs, executors, and administrators, agree to indemnify and hold harmless the Released Parties against all Claims, each of every kind and nature whatsoever, which may in any way arise out of or result from your and/or minor child’s acts or omissions . The indemnity contained in this paragraph will apply even if any Losses are caused, in part, by the Released Parties’ own negligence.
3. Photography & Videography
a) Acknowledgement:
You acknowledge that NHT may wish to film, photograph, or otherwise record your or your minor child’s image, voice, likeness, creations, or performance (collectively referred to as “Materials”), and may wish to display, publish, or distribute the Materials on NHT’s website, social media accounts, or in NHT’s promotional materials or internal publications. You acknowledge that by your/your minor child’s participating in NHT activities or in the camp and classes, where the Materials may be captured.
b) Consent:You give consent to NHT to film, photograph, or otherwise record the Materials, and display, publish, or distribute the Materials (including altering or modifying the Materials) for the promotional and educational uses on and/or in:
NHT's website and social media platforms
NHT's printed promotional materials
NHT's internal publications (e.g., invitations)
c) Assignment:You hereby irrevocably and unconditionally assign and transfer to NHT all right, title, or interest that your minor child or you may have throughout the world in the Materials, without any limitation of time, for the promotional and educational uses. You acknowledge and agree that NHT and its successors, and assigns, may use the Materials for promotional and educational uses, by means of all forms, media, and technologies whatsoever. You agree that no compensation will be given for promotional and educational uses of the Materials.
d) Opt-Out:If you do not consent to photography or videography, you must notify NHT in writing using the opt-out form to nutritionhealthtours@gmail.com.
e) Restriction:You acknowledge and agree that you will not re-post any Materials from any of the following sources: NHT’s website, social media accounts, promotional materials and/or internal publications, on any of your own social media accounts unless they solely contain images of you and/or your minor child.
4. Fees & Payment Policy
Fees must be paid in full upon registration and payments must be made via E-transfer to nutritionhealthtours@gmail.com or, via Paypal.
5. Late Pick-Up Policy
A $30 late fee will be charged each time a participant is picked up after the scheduled end time of camp or class, or beyond the paid after-care period. After three late pick-up incidents, the participant may be dismissed from the camp or classes without refund.
GOVERNING LAW AND JURISDICTION
You agree that any claim or dispute you may have against Nutrition Health Tours (“NHT”) must be resolved by a court located in Alberta, Canada. You consent to the personal jurisdiction of the courts in Edmonton, Alberta, for the purpose of litigating any such claims or disputes. This Agreement and any related rights, duties, and obligations between the parties shall be governed by and interpreted exclusively in accordance with the laws of the Province of Alberta, Canada.
AGREEMENT ACKNOWLEDGEMENT
You acknowledge that you have thoroughly read and understand the terms and conditions of this Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement and you understand that you are giving up substantial rights on behalf of yourself and/or your minor child by signing it. You understand that you have the right to seek independent legal counsel to review and advise you on the terms of this Agreement before signing.You are signing this Consent, Release and Waiver knowingly, voluntarily and without any inducement.
This Agreement, along with any applicable policies and agreements outlined in the Terms and Conditions, constitutes the entire understanding between you and Nutrition Health Tours (“NHT”) regarding the Cooking Class/Camp services. It supersedes any prior oral or written understandings, except for any registration agreements or other non-conflicting documents executed contemporaneously with this Agreement, which shall be read in conjunction with this document. This Agreement may only be modified in writing by both parties.
By completing your purchase, you accept and agree to all terms and conditions of this Agreement and authorize us to charge the applicable fees to the credit card provided at the time of registration. We reserve the right to amend this Agreement at any time by posting an updated version on our official website or any future platform we may use.
