ACKNOWLEDGMENT OF RISK AND RELEASE OF LIABILITY

WARNING: THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY.

Every person must read and understand this waiver before participating in equine activities.

The following waiver of all claims, release from all liability, assumption of all risks, agreement not to sue, and other terms of this agreement are entered into by me (the “Participant”) with and for the benefit of Windsor-Essex Equestrian Centre, Pearce Medical Services Inc., Dr. Pearce Medicine Professional Corporation, Craig Pearce, C. Patricia Pearce, Lindsay Traisnel, Xavier Traisnel, and all employees, volunteers, business operators, agents, and related family members (collectively, the “Host”).

“Equine Activities” includes, but is not limited to, horse shows, horse riding, horse boarding, and riding instruction provided by the Host to the Participant.

1. I understand and acknowledge that there are inherent dangers, hazards, and risks associated with Equine Activities, including the risk of serious injury, death, property damage, or loss.
2. I understand that horses may behave unpredictably and may react to sounds, sudden movements, unfamiliar people, animals, or objects in ways that could result in injury.
3. I voluntarily accept and fully assume all risks associated with participation in Equine Activities.
4. I acknowledge that although the Host takes reasonable steps to reduce risk and increase safety, Equine Activities cannot be made completely safe.
5. MINORS / PARENT OR GUARDIAN CONSENT
   If the Participant is under the age of majority, the undersigned parent or legal guardian confirms that:

• They are the lawful parent or guardian of the minor Participant;
• They have the legal authority to enter into this Agreement on behalf of the minor;
• They consent to the minor’s participation in Equine Activities;
• They agree to all terms of this Agreement on behalf of the minor and themselves, including the waiver of claims and release of liability.

1. In consideration for being permitted to participate in Equine Activities, I agree to:

• Waive all claims I may have against the Host;
• Release and forever discharge the Host from liability for any injury, death, damage, or loss arising from participation in Equine Activities, including claims arising from negligence;
• Indemnify and hold harmless the Host from any claims, demands, costs, or liabilities arising from my participation.

1. This agreement shall be governed by the laws of the Province or Territory of Canada in which the Equine Activities are provided.

By selecting “I Have Read and Agree” and typing my name, I acknowledge that:

• I have carefully read and fully understand this Agreement;
• I understand that I am waiving certain legal rights, including the right to sue;
• I am voluntarily agreeing to these terms;
• I understand that my typed name constitutes my electronic signature and has the same legal effect as a handwritten signature.

Medical Emergency Authorization

In the event of an accident, injury, illness, or other medical emergency involving the participant, I authorize riding school staff to provide basic first aid, contact emergency medical services (911) if deemed necessary, and contact the parent/guardian and/or emergency contact listed on the participant’s account.

If immediate medical attention is required and a parent/guardian cannot be reached promptly, I authorize emergency medical personnel to provide treatment and transportation as necessary.

I understand that it is my responsibility to keep all emergency contact information and medical information current within my account.

Code of Conduct

This Code of Conduct applies to all participants, riders, parents/guardians, and visitors at Windsor-Essex Equestrian Centre (“the Centre”). It is designed to ensure a safe, respectful, and positive environment for all individuals and animals.

By participating in programs at the Centre, you agree to follow the rules outlined below.

1. SAFETY FIRST
   All participants must follow instructor directions at all times. Unsafe behavior, including actions that may endanger people or horses, is not permitted.
2. RESPECT FOR HORSES
   Horses must be treated with care and respect at all times. Rough handling, abuse, or behavior that causes distress to an animal is strictly prohibited.
3. RESPECT FOR STAFF AND OTHERS
   Participants must treat instructors, staff, volunteers, and other riders with respect. Harassment, bullying, or disruptive behavior will not be tolerated.
4. RULE COMPLIANCE
   All barn rules, arena rules, posted safety guidelines, and speed limits on the property must be followed at all times. Drivers must follow all posted speed limit signs throughout the farm and operate vehicles with extreme caution due to horses and pedestrians.
5. PARKING
   All vehicles must be parked in the designated riding school parking lot only. Parking in unauthorized areas is not permitted.
6. EQUIPMENT AND PROPERTY
   All equipment must be used properly and returned as instructed. Damage to property due to misuse may result in responsibility for repair or replacement costs.
7. SUPERVISION OF MINORS
   Parents/guardians are responsible for ensuring minors understand and follow this Code of Conduct while on the premises.
8. RIGHT TO REMOVE PARTICIPANTS
   The Centre reserves the right to remove any participant, rider, or visitor from programs or premises at its discretion if behavior is unsafe, disruptive, or violates this Code. No refund is required in such cases.

I give permission for myself/my child to be photographed or filmed and for these images/recordings to be used by the organization for communication and promotional purposes.
