General Release Waiver

TO: Kelowna City FC Academy Inc. (KCITY), and their directors, officers, agents, representatives, employees, volunteers, members, participants, spectators, Districts, Leagues, Clubs, independent contractors, subcontractors, sponsors, successors and assigns (collectively the “RELEASEES”)

DEFINITIONS: In this Agreement, the term "soccer programs " shall include all activities, programs, events, classes, and services provided, sponsored or organized by KCITY, including but not limited to: games, tournaments, practices, personal training, dry land training, use of strength training and fitness conditioning equipment, machines and facilities, nutritional and dietary programs, orientational or instructional sessions or lessons, aerobic and anaerobic conditioning programs.

ASSUMPTION OF RISKS: I am the parent/guardian of the player being registered and have full legal responsibility for the decisions of said player. I believe my child/ward is physically, emotionally and mentally able to participate in soccer programs and is doing so voluntarily and willingly. I am aware that my child/ward’s participation in soccer programs involves many risks, dangers and hazards, which could result in damage, loss, serious physical injury or death to my child/ward. I have spoken to my child/ward and have made my child/ward aware of these risks, dangers and hazards. Some of these risks, dangers and hazards include, but are not limited to:

Health: overexertion, dehydration, fatigue, lack of fitness or conditioning, traumatic injury, bacterial infections, rashes, and the transmission of communicable diseases, including viruses of all kinds, bacteria, parasites or other organisms or any mutation thereof.

Premises: defective, dangerous or unsafe condition of the facilities; falls; collisions with objects, walls, equipment or persons; dangerous, unsafe, or irregular conditions on grass, turf or other surfaces, extreme weather conditions; travel to and from premises

Use of Equipment: mechanical failure of the equipment; negligent design or manufacture of the equipment; the provision of or the failure by the Releasees to provide any warnings, directions, instructions or guidance as to the use of the equipment; failure to use or operate the equipment within my own ability.

Contact: I acknowledge that contact with soccer balls, other equipment, or other persons, whether intentional or unintentional, is a common part of soccer programs and may lead to serious bodily injury, including but not limited to concussions and/or other brain injury, or serious spinal injury.

Advice: negligent advice regarding soccer programs

My child/ward’s conduct and conduct of other persons, including any physical altercation between soccer participants: I acknowledge that such conduct, including my child/ward’s negligence and negligence of other persons, including NEGLIGENCE ON The PART OF THE RELEASEES, may increase the risk of damage, loss, personal injury or death. I understand that the Releasees may fail to safeguard or protect my child/ward from the risks, dangers and hazards of soccer programs, some of which are referred to above.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the Releasees allowing my child/ward to participate in soccer programs, use its equipment and facilities and provide its soccer services and consultation, I hereby agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death that I or my child/ward may suffer or that my next-of-kin may suffer as a result of my or my child’s/ward’s participation in soccer programs DUE TO ANY CAUSE WHATSOEVER, including but not limited to:

negligence on the part of the Releasees;

breach of contract by the Releasees;

breach of warranty on the part of the Releasees in respect of the design, manufacture, selection, installation, maintenance or

adjustment of equipment;

breach of any statutory or other duty of care, including any duty of care owed under the Occupiers Liability Act, R.S.B.C. 1996, c. 303, on the part of the Releasees; and

the failure on the part of the Releasees to safeguard or protect me or my child/ward from the risks, dangers and hazards of soccer programs, some of which are referred to in the Assumption of Risks section of this Agreement.

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage, loss, expense or injury to my child/ward resulting from my child’s/ward’s participation in soccer programs DUE TO ANY CAUSE WHATSOEVER, including but not limited to negligence on the part of the Releasees; breach of contract by the Releasees; breach of warranty on the part of the Releasees in respect of the design, manufacture, selection, installation, maintenance or adjustment of equipment; breach of any statutory duty or other duty of care including any duty of care owed under the Occupiers liability Act, R.S.B.C. 1996, c. 303, on the part of the Releasees; and the failure on the part of the Releasees to safeguard or protect my child/ward from the risks, dangers and hazards of soccer programs, some of which are referred to in the Assumption of Risks section of this Agreement.

3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage, loss, expense or injury to any third party resulting from my child’s/ward’s participation in soccer programs.

4. Despite the risks, dangers and hazards of soccer programs, and fully understanding such risks, dangers and hazards, I wish my child/ward to participate in soccer programs with the Association, and I FREELY ACCEPT AND FULLY ASSUME all such risks, dangers and hazards and the possibility of personal injury, death, property damage and loss resulting therefrom.

5. This Agreement shall be effective and binding upon my heirs, next-of-kin, executors, administrators, assigns and representatives in the event of my death or incapacity. SAFETY: In entering into this Agreement, I am not relying on any oral, visual or written representations or statements made by the Releasees with respect to the safety of soccer programs other than what is set forth in this Agreement. INSURANCE: I am aware that the Association carries insurance and that should my child/ward become injured or cause personal injury or property damage to any third party while participating in soccer programs, my child/ward may or may not be entitled to insurance coverage depending on the terms and conditions of the Association’s insurance policy. JURISDICTION: This Agreement and any rights, duties and obligations as between the parties to this Agreem

Kelowna City FC - Payment Policy

When registering for Kelowna City FC programs, you have agreed to abide by the following policy and agree to the terms laid out below:

General Registration/Payment Terms

Upon registration for a program, you are committing to the payment agreement for the duration of the program. We follow a no-refund policy for programs. As an organization, there may be instances where a player is registered and costs are incurred by Kelowna City FC before a program's commencement and fees are utilized before program start.

We understand that there may be instances where a player may not be able to finish a program they are registered for, i.e., a medical withdrawal. In these instances, we require supporting documentation to proceed with any review of a payment adjustment or stop payment. Any program fees that have been fully paid will not be refunded.

Should a medical withdrawal occur and be approved, a $50 administrative fee will be charged to the account, and the program registration will be cancelled.

In the case of a medical withdrawal, for which the registration fees have been paid in full, a maximum of $500 may be credited to the account for future use.

As our programs tend to fill up quickly and sell out fast, please note the following:

Refunds will not be processed due to withdrawals based on scheduling conflicts or training locations.

We do not pro-rate programs based on player availability.

If you believe you have made an error in registration, please notify us within a 24-hour period to remedy the situation.

Upon registration for Kelowna City FC programming, you immediately enter into a payment process or payment plan, depending on programming options.

Requests for Withdrawal or Account Adjustment

Formal requests for program cancellation must be presented to and approved by the Director of Finance at finance@kelownacityfc.com. Any discussion with other club employees per withdrawals or refunds are not binding; only the Director of Finance has the authority to grant payment accommodations, revisions or refunds.

Kelowna City FC - Email Release

By registering your child in our programming, you agree that Kelowna City FC Academy Inc., and business owners will have access to such information in order to contact you for customer service purposes. Your email address is used only for internal purposes and is not shared with people or organizations outside of Kelowna City FC, its subsidiaries or successors in interest, and its business partners, with the exception of registration information which may be shared with governing bodies, including, but not limited to COYSA, BC Soccer and Canada Soccer.

We do not sell, trade, or rent users' personal identification information to others.

Release of Information

Kelowna City FC Academy Inc. will release any information that is required to be released by law or court order.

Your acceptance of these terms

Kelowna City FC - Training Kit (All U7+ Players)

All new players to Kelowna City FC (U7+) will need to purchase a training kit (listed https://kelownacityfc.com/training-gear) upon registration.

This training kit consists of 2 jerseys (black + grey), shorts and socks to be worn to each training session with the club. All players (U7+), whether team players or players wanting supplemental training, must purchase this kit. The kit is a one-time purchase; players only need to purchase new items as they outgrow them. If your kit has not arrived before the first training day, please wear athletic gear to the pitch.

MEDIA WAIVER

I hereby agree and give consent for Kelowna City FC Academy Inc. (KCITYFC), and/or partners to record, film, photograph, audiotape or videotape my child’s name, image, and performance (herein collectively referred to as “Recordings”). I hereby consent to the use of Recordings or my child’s name for advertising, promotional or commercial purposes of any kind at the sole discretion of KCITY including, but not limited to, the KCITY website, brochures, blogs, all social media platforms—including, but not limited to Facebook, Twitter, Instagram, SnapChat, TikTok, YouTube, and/or for broadcasting on television or radio as determined by KCITY. I understand that the recordings may appear in electronic form on the Internet..

I agree that I will not hold Kelowna City FC (KCITY), responsible for any harm that may arise from any unauthorized reproduction. I hereby waive any right to approve the use of this content now or in the future, whether the use is known to me or unknown, and I waive any right to any royalties related to the use of this content.

I hereby release, Kelowna City FC (KCITY), its officers, employees, agents and its advertising and promotional agencies from any and all claims, demands, damages, actions, causes of action whatsoever which I, my heirs, executors, administrators may now or hereafter have against them or any part of them in respect to relating to the use of the Recordings, including but not limited to libel and invasion of privacy. I understand that unless I specify otherwise in writing, that these images and recordings will be used until such time as I request KCITY does not do so.

By clicking below, I give this consent and release voluntarily on behalf of the individual named and I understand and agree to be bound by its contents.
 

PARENT / GUARDIAN APPROVAL

I hereby request and give permission to Kelowna City FC Staff, including instructors, supervisors, and volunteers to assist my child in administering prescribed medicine or to authorize medical treatment to my player in the event that I am not able to be present when this treatment is needed according to the instructions completed above by the parent/guardian. I fully acknowledge that with the administration of medication, there may be certain risks or hazards for which I will not hold Kelowna City FC or any of its staff, volunteers or members responsible for.

Kelowna City FC Academy Inc. – Terms and Conditions

1. Acceptance of Terms
By purchasing any product or service from Kelowna City FC Academy Inc., you agree to abide by these Terms and Conditions.
2. Product Purchase
Payment: Full payment for products and services provided by Kelowna City FC Academy Inc. is due at the time of purchase.
Non-Refundable: All purchases are final and non-refundable.
3. Package Services
Services Provided: Each product or service provided by Kelowna City FC Academy Inc. includes specific offerings as outlined in the respective package description.
Service Modifications: Kelowna City FC Academy Inc. reserves the right to modify, update, or discontinue any service or feature included in a package, at its discretion and without prior notice.
Service Limitations: Certain services or features may be subject to usage limits or restrictions.
4. Intellectual Property
Ownership: All intellectual property, including but not limited to copyrights, trademarks, and trade secrets, associated with Kelowna City FC Academy Inc. products and services, remains the sole property of Kelowna City FC Academy Inc.
5. Limitation of Liability
No Warranty: All products and services are provided “as is,” with no warranties, either express or implied.
Limitation of Liability: Kelowna City FC Academy Inc. shall not be held liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our products or services.
6. Termination
Termination by Kelowna City FC Academy Inc.: We reserve the right to terminate your access to any product or service at any time, with or without notice, and for any reason, including but not limited to violations of these Terms and Conditions.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of [Jurisdiction].
8. Modifications to Terms and Conditions
Kelowna City FC Academy Inc. may update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website.
