COACH CONTRACT

Employment

I accept employment with HamOnt Sports Limited (the Company) for the position of Coach.

Compensation and Schedule

I accept the minimum remuneration of $19.00 per hour. 

I understand there is no minimum guaranteed number of weekly hours and that my assigned shifts may vary from week to week within the contract period.

I understand that I may accept unlimited additional shifts, as they become available, but I may not work more than 88 hours in a single 14-day pay period.

I understand that I will receive an additional 4% pay which is in lieu of paid vacation. I acknowledge that requests for unpaid days off must be submitted at least two (2) weeks prior and may or may not be approved.

I acknowledge that I am expected to work all scheduled shifts. The Company acknowledges that circumstances may arise where I am legitimately unavailable to work, however repeat and unexplained absences may result in dismissal.

I accept that COVID related government restrictions may change the Company’s ability to operate as planned. These restrictions could result in a delayed start, season extension and/or reduced season length which could impact hours. Restrictions may also change working conditions such as requirement to mask and/or need for additional vaccinations.

I understand this contract expires at the end of each session. 

Duties & Expectations

I will faithfully, honestly and diligently serve the Company, and shall not be employed or engaged in any capacity that is competitive with the business activities of the Company.

I confirm and promise that by signing this Contract I have never been accused of, or charged with any criminal offence relating to the harming or mistreatment of children, or any criminal offence of a violent or sexual nature.

I understands that it is a strict condition of the terms of their employment that they will never allow themselves to be in a situation in which they are alone with a child, who is a client of the Employer’s, without at least one other adult present. The Employee understands that this condition is material to the Employer’s consent to enter into this employment Agreement and that violation of this provision may lead to immediate termination for just cause and without notice.

Confidential Information

I acknowledge that in the course of employment, I will be entrusted with detailed confidential information of the Company and customers. I agree to maintain confidential such detailed information and confirm that the Company shall be entitled to seek injunctive relief in the event I breach confidentiality of the information.

I acknowledge the above provisions shall survive the termination of this Contract by either party for any reason.

Electronic Notices & Pay

I consent to receiving electronic payroll records (pay stub) and electronic tax forms (T4).

I understand I will be paid in bi-weekly direct deposit installments five (5) days after the end of the pay period.

Termination

I understand and agree that if my employment is terminated by the Company for any reason other than willful misconduct, my entitlements will be limited to the entitlements set out in the Employment Standards Act, 2000 (or any successor legislation). For clarity, in no case will I be entitled to receive common law reasonable notice or compensation in lieu of notice. This provision shall remain in full force and effect regardless of any changes to my position or remuneration in the future. If I am terminated for willful misconduct as defined by the Employment Standards Act of Ontario I will receive no notice.

Contract and Legal Advice

This Contract constitutes the entire contract between myself and the Company concerning the employment of myself with the Company and supersedes all prior agreements, oral or written.

I acknowledges that I have had sufficient time to review and understand this Contract and have been given sufficient time to obtain legal advice concerning the interpretation and effect of this Agreement.

The Contract will be executed on the date of electronic submission.
