The Recreation and Parks Association of the Yukon (“RPAY”) is a not-for-profit society dedicated to empowering Yukon people and communities to adopt active and healthy lifestyles. 

RPAY works collaboratively with organizations and communities to create environments that encourage recreation and parks opportunities for all Yukoners. RPAY’s extensive programs and services are supported by its territorial, northern, and national multi-sectoral partnerships with groups, schools, communities, and governments.

RPAY provides programming to the public both directly and indirectly. RPAY also provides training, again both directly and indirectly, in furtherance of RPAY’s programming and objectives. These are referred to as “RPAY Activities” in this document.

As a community not-for-profit society, RPAY engages in and is associated with activities that may bring with them certain risks.

By (i) voluntarily participating in any RPAY Activities or, (ii) having RPAY provide services or training either directly or indirectly,  you are voluntarily assuming all risks associated with all such activities. 

Accordingly, by signing this document you are agreeing and confirming that you are aware that there are risks associated with RPAY Activities and that you are assuming all such risk with respect to your participation or involvement in all such activities.

Agreement and Confirmation

Our association, school, government department or organization (The “Organization”) is aware that RPAY Activities have many inherent risks, both foreseeable and unforeseeable, ranging from minor to catastrophic.

Acknowledgement of Risks

I/We understand that these risks include, but may not be limited to the following risks: 

Health: executing physical techniques; physical exertion; overexertion; stretching; dehydration; fatigue; cardiovascular workouts; rapid movements and stops; lack of fitness or conditioning; traumatic injury; sprains and fractures, spinal cord injuries, bacterial infections; rashes; and the transmission of communicable diseases, including viruses of all kinds, bacteria, parasites or other organisms or any mutation thereof; exposure to insects and ticks;

Premises: defective, dangerous or unsafe condition of the facilities; dangerous, unsafe, or irregular conditions; and travel to and from the premises; including possible injury due to falls on even and uneven surfaces, steep or slippery roads and the natural environments and structures found in playgrounds, parks and trails;

Use of equipment: mechanical failure of the equipment; negligent design or manufacture of the equipment; the provision of, or the failure to provide any warnings, directions, instructions or guidance as to the use of the equipment; failure to wear safety or protective equipment; and failure to use or operate equipment within my own ability; including injury or illness resulting from the use of an indoor or outdoor facility such as a school, field, play surface, community hall, classroom, gymnasium or playground;

Advice: negligent advice regarding the RPAY Activities;

Ability: failing to act safely or within my own ability or within designated areas;

Sport and Activity: the inherent risks of sport and activity including but not limited to slipping, falling or colliding; all or any of which may lead to serious bodily injury, including but not limited to concussions and/or other brain injury or serious spinal injury;

Conduct: my conduct and conduct of other persons including any physical altercation between participants;

Travel: travel to and from the RPAY Activities, including the possibility of sudden impact with terrain features that may result in bodily injury or death caused by, but not limited to making contact with rocks, trees, obstructions, and other participants, visible or non-visible, entanglement or impalement, and motor vehicles;

Cyber: RPAY may offer or promote online programming (such as webinars, remote conferences, workshops, and online training) which have different foreseeable and unforeseeable risks than in-person programming, including privacy breaches, hacking, technology malfunction or damage.

Negligence: RPAY may be negligent, which may include failure to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with participation in the RPAY Activities.

Weather: injury or illness resulting from exposure to cold, wet or windy weather, or the effects of heat and strong sunlight.

Remoteness: the possibility of becoming lost and the inability to access medical help in an emergency.

Wild Animals: curious or aggressive wildlife may include bears, carnivores, domestic or non-domestic animals. 

Hazards of Unsupervised Activities: the possibility of unforeseen circumstances associated with staying overnight away from home and taking part in unsupervised activities may result in bodily injury, death, emotional harm, damage or loss.

Agreement

In consideration of RPAY allowing us to participate in the RPAY Activities, our Organization agrees as follows:

1. We are voluntarily participating in an RPAY Activity.
2. We will comply with the rules and regulations for participation in the RPAY Activities.
3. We will comply with the rules with respect to the use of any facility or equipment.
4. It is our sole responsibility to assess whether any RPAY Activities are too risky for us.
5. By starting an RPAY Activity, we acknowledge and accept the suitability and condition of the RPAY Activity and accept all risk relating to the activity.
6. Neither RPAY nor any of its directors, officers, employees, sponsors, independent contractors, members, players or agents assume any responsibility whatsoever for our safety during the course of my preparation for, or participation in, any RPAY Activity.
7. RPAY and its directors, officers, employees, contractors, instructors, volunteers, agents or representatives are not responsible for any death, injury, loss or damage of any kind suffered by us while travelling to and/or from any RPAY Activity, participating in such activity, or during any unsupervised overnight stay which may be associated with such activity.
8. We are responsible for choosing any safety or protective equipment or preventative measures.
9. We assume all risks arising out of, associated with, or related to, participation in any RPAY Activity and waive any and all claims that we may have now or in the future against RPAY. 
10. We fully assume all such risks and possibility of personal injury, death, property damage, expense and related loss, including loss of income, resulting from participation in any RPAY Activity.
11. RPAY is not responsible or liable for any damage to our vehicles, properties, or equipment that may occur as a result of any RPAY Activity. 
12. We have read this Agreement and understand it and are signing this Agreement voluntarily.
13. This Agreement is binding upon us, our successors, officers, directors, employees, and third parties acting on our behalf. 
14. By signing this Agreement, we have waived any right to maintain a lawsuit against RPAY on the basis of any claims from which RPAY has been released herein.
15. This Agreement is intended to be as broad and inclusive as is permitted by laws of Yukon and, if any portion thereof is held invalid, the balance shall continue in full legal force and effect.

15. This Agreement is intended to be as broad and inclusive as is permitted by laws of Yukon and if any portion thereof is held invalid, the balance shall continue in full legal force and effect.
