NOURISH COOKING COMPANY PARTICIPATION AGREEMENT, ASSUMPTION OF RISK, AND WAIVER OF LIABILITY (Province of Ontario) In consideration of my child being permitted to participate in programs, classes, camps, workshops, and activities operated by Nourish Cooking Company (“NCC”), I acknowledge and agree as follows:
1. ENROLLMENT NCC reserves the right to remove or refuse participation of a child whose behaviour poses a safety risk to themselves, other participants, or staff, or significantly disrupts the program environment. • NCC is committed to compliance with the Ontario Human Rights Code and will accommodate children to the point of undue hardship. Parents/guardians will be notified if concerns arise regarding safety, behavioural, developmental, or other issues affecting participation.
2. REFUND POLICY • REGISTRATION, CANCELLATION & CREDIT POLICY Enrollment in a Nourish Cooking Company program reserves a limited space for your child. Registration fees allow us to secure staffing, facilities, supplies, insurance, and other program costs in advance. All registrations are final and all fees are non-refundable. If a participant withdraws 45 days before the program start date, the registration fee will be converted to a non-refundable account credit, valid for two (2) years from the request to withdraw date. Credits may be applied toward any eligible Nourish Cooking Company camp, class, or program, subject to availability. If a parent withdrawls 45 days or less before the start date, no credit will be issued. No refunds, credits, transfers, or make-up days will be provided for absences, illness, dismissal, early withdrawal, scheduling conflicts, or any other reason. Credits: have no cash value; are transferable; may not be exchanged for a refund; and expire two (2) years from the original withdrawl date which will be considered as the day the eamil was recivevd.. Exceptions to this policy may be made only if required by applicable law.
3. MEDICAL INFORMATION & EMERGENCY AUTHORIZATION I confirm that all information provided in the registration form is accurate and complete and agree to notify NCC immediately of any changes, including medical or allergy information. To the best of my knowledge, my child is physically able to participate. If I cannot be reached in the event of illness or injury, I authorize NCC to seek medical treatment for my child as deemed necessary, including transportation to a medical facility. I understand that I am financially responsible for any medical treatment provided. NCC’s responsibility for supervision begins when my child has been signed in to the program and ends when my child has been signed out.
4. ALLERGIES & FOOD-RELATED RISKS I understand that NCC programs involve the preparation and handling of food ingredients, including common allergens such as nuts, dairy, eggs, wheat, soy, sesame, and others. I acknowledge that: • I am responsible for fully disclosing all known allergies, sensitivities, or dietary restrictions. • NCC cannot guarantee an allergen-free environment. • Cross-contamination may occur despite reasonable precautions. • Exposure to allergens may result in serious allergic reactions, including anaphylaxis. I knowingly assume all risks associated with food allergies and ingredient exposure.
5. ASSUMPTION OF RISK – COOKING ACTIVITIES I understand that participation in a children’s cooking program involves inherent risks, including but not limited to: • Burns from ovens, stovetops, hot pans, boiling liquids, and steam • Cuts from knives, graters, peelers, and kitchen tools • Slips or falls on wet or food-covered floors • Minor injuries such as scrapes, bruises, and sprains • Choking hazards • Use of small appliances and kitchen equipment • Exposure to heat sources and open flame (where applicable) I understand that these risks are inherent in cooking activities and may occur even with appropriate supervision and safety procedures. I voluntarily permit my child to participate and knowingly assume these risks.
6. COMMUNICABLE ILLNESS I acknowledge that participation in group programs involves interaction with others and carries a risk of exposure to communicable illnesses. I agree not to send my child to a program while ill and accept the inherent risk of exposure despite reasonable precautions.
7. RELEASE OF LIABILITY To the fullest extent permitted by the laws of the Province of Ontario, I release and hold harmless Nourish Cooking Company, its directors, officers, employees, contractors, and agents from liability for injury, illness, loss, or damage arising from my child’s participation in NCC activities, except where such injury or loss is the direct result of NCC’s gross negligence or willful misconduct. This release applies to claims arising from ordinary risks inherent in cooking and program participation.
8. INDEMNIFICATION I agree to indemnify and hold harmless NCC from any claims, actions, damages, costs, or expenses (including legal fees) arising from my child’s participation, except where caused by NCC’s gross negligence or willful misconduct.
9. PRIVACY NCC collects and stores personal information in accordance with applicable Ontario and federal privacy legislation, including PIPEDA. Personal information will be used only for program administration, safety, and communication purposes and will not be sold or shared except as required by law.
10. SEVERABILITY & GOVERNING LAW This agreement shall be governed by the laws of the Province of Ontario. If any provision of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect. Any disputes arising from this agreement shall be resolved within the Province of Ontario.
11. ACKNOWLEDGMENT I confirm that: • I am the parent or legal guardian of the participating child. • I have carefully read and understood this agreement. • I understand that by signing this document, I am giving up certain legal rights on behalf of myself and my child. • I sign this agreement freely and voluntarily. Electronic signatures are accepted as legally binding.
