I GUARANTEE THAT:
1. I am a parent/guardian with full legal responsibility for decisions regarding my minor child/ward, and
2. I am aware of the risk of serious injury and death that any participant in this program must assume, and
3. I believe that my minor child/ward is physically, emotionally, and mentally capable of participating in this program, and that their equipment is mechanically suitable for use in this program, and
4. I understand, and will instruct my minor child/ward, that all applicable participation rules must be followed and that at all times the sole responsibility for personal safety rests with my minor child/ward, and
5. I will immediately withdraw my minor child/ward from participation and inform the nearest official if at any time I feel or observe an unusual danger or hazardous condition or if I believe that my minor child/ward has experienced a deterioration in their health status or physical, emotional, or mental fitness to continue participating in the program.
I UNDERSTAND AND ACCEPT, ON BEHALF OF MY MINOR CHILD: MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, THAT MY SIGNATURE ON THIS DOCUMENT CONSTITUTES:
1. an UNCONDITIONAL ACCEPTANCE OF ALL RISKS associated with my minor child/ward's participation in this program even if they arise from negligence or gross negligence including any aggravation or worsening of injuries caused by negligent rescue operations or procedures by the program organizer and all persons associated with or participating in it, and
2. a COMPLETE AND FINAL RELEASE OF LIABILITY of the program organizer and all persons and organizations associated with it and the program including but not limited to its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, owners and/or lessors of premises used to conduct the program, sanctioning bodies, medical personnel or rescuers (the RELEASEES), from any injury, disability, death or loss or damage to person or property resulting from the negligence or negligent rescue of those above-mentioned persons or otherwise; and
3. an AGREEMENT NOT TO SUE the RELEASEES for any loss, injury cost or damage of any kind whatsoever regardless of cause or occurrence whether directly or indirectly arising from my minor child/ward's participation in the program; and
4. an AGREEMENT TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES from any litigation expenses attorney fees liability damages awards costs of any kind which they may incur as a result of any claim made against them or any one of them whether the claim is based on their negligence or gross negligence.
I HAVE READ THIS DOCUMENT CAREFULLY.
I UNDERSTAND THAT THE RELEASEES ARE RELYING ON MY WARRANTIES ASSUMPTIONS WAIVER AND RELEASE COMMITMENTS AND AGREEMENTS WHEN THEY ACCEPT MY MINOR CHILD/WARD'S PARTICIPATION IN THIS PROGRAM.
I UNDERSTAND THAT BY SIGNING THIS DOCUMENT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS THAT ME OR MY MINOR CHILD/WARD WOULD OTHERWISE HAVE.
I SIGN THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT.
