By accessing our website, registering a child (the “Camper”) for the Fun Adventure Inc. (“Fun Adventure”) Summer Camp (the “Camp”), you as the Camper’s parent or legal guardian (the “Parent/Guardian”), acknowledge that you have read, understood, and agree to the following Terms and Conditions & Waiver of Liability (this “Agreement”).
Participation in Camp activities involves inherent and reasonably foreseeable risks, regardless of the precautions taken by Fun Adventure, including but not limited to physical activity, games, group interaction, outdoor play, field trips, transportation, exposure to communicable illnesses, use of facilities, and unforeseen events or activities that may occur despite reasonable supervision and safety measures.
By enrolling the Camper, you voluntarily acknowledge and accept these risks on their behalf.
Only the Parent/Guardian is authorized to pick up the Camper from Camp, unless you notify us in writing of a person authorized to pick up the Camper and provide a copy of their government-issued photo identification. Matching government-issued photo identification will be required at time of pick up.
Late Pickup Policy: If a Camper has not been picked up within 15 minutes of the scheduled end time, Fun Adventure will attempt to contact you. Repeated late pickups may result in additional fees or dismissal from the Camp.
To the fullest extent permitted by law, you, the undersigned Parent/Guardian, on behalf of yourself, the Camper, and your respective heirs, executors, administrators, successors, and assigns, hereby:
i) Waive any and all claims, demands, actions, causes of action, suits, damages, expenses, costs (including legal fees), and liabilities of every kind and nature, whether known or unknown, which may now exist or may hereafter arise (“Claims”) against Fun Adventure and its directors, officers, employees, volunteers, contractors, agents, successors, and assigns (the “Released Parties”) arising from or in any way connected with the Camper’s enrolment in, attendance at, or participation in Camp or any Camp activities, whether on-site or off-site;
ii) Fully and forever release and discharge the Released Parties from any and all Claims, including but not limited to Claims arising from or related to personal injury, illness, disease, emotional distress, death, property damage, or property loss, howsoever caused;
iii) Agree not to sue or bring any action or proceeding against the Released Parties in respect of any Claims arising from the Camper’s participation in Camp; and
iv) Agree to indemnify and hold harmless the Released Parties from and against any and all Claims, including third-party claims, demands, actions, or costs (including legal fees on a full indemnity basis) arising from the Camper’s participation in Camp, from any breach of this Agreement by you, or from the inaccuracy of any information provided in this Agreement.
This waiver and release applies to all Claims regardless of the cause of action, including but not limited to Claims based on or arising from negligence, gross negligence, breach of contract or any term of this Agreement, breach of any duty of care (statutory or otherwise), and any act, omission, or default of the Released Parties, whether arising in contract, tort, statute, or otherwise.
Without limiting the generality of the foregoing, and to the fullest extent permitted by law, the Released Parties shall not be liable to you, the Camper, or any other person for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to the Camper’s participation in Camp, nor for any damages for personal injury, pain and suffering, emotional distress, loss of enjoyment, medical expenses, property damage, or loss of income, regardless of the cause of action and even if the Released Parties have been advised of the possibility of such damages. The total aggregate liability of Fun Adventure to you, Camper, or any other person shall not exceed the fees paid by you to Fun Adventure.
Nothing in this agreement limits or excludes liability where such limitation or exclusion is not permitted by law.
Fun Adventure may use third-party service providers, venues, or transportation services for certain camp activities or field trips.
While Fun Adventure takes reasonable steps to select reputable providers and to supervise campers during field trips, these third-party providers operate independently and maintain their own policies, procedures, and safety standards.
To the fullest extent permitted by law, Fun Adventure, its directors, officers, employees, volunteers, contractors, agents, and the owners or operators of premises used for camp activities (including rented facilities such as Anapilis Halls), shall not be liable for injury, loss, or damage arising from the acts or omissions of such third parties.
Subject to the following exceptions, Fun Adventure will not administer medicine to the Camper. You are responsible for disclosing any allergies or other medical conditions of the Camper that Fun Adventure should be aware of.
In the event that the Camper has a medical emergency, and where you cannot be reached, you authorize Fun Adventure staff to:
• Administer basic first aid;
• Contact emergency medical services (911);
• Authorize and consent to emergency medical treatment, including hospitalization, surgery, and anesthesia, as deemed necessary by qualified medical professionals; and
• Transport or arrange transportation of the Camper to the nearest appropriate medical facility.
You agree to assume responsibility for all associated medical and transportation costs.
b. Epinephrine Administration
Where necessary, Fun Adventure staff may administer epinephrine in good faith in accordance with the Camper’s anaphylaxis emergency plan and Ontario’s Sabrina’s Law, and you consent to such administration. Fun Adventure shall not be liable for injury arising from the good faith administration of emergency epinephrine.
To protect all campers and staff, the Camper must not attend Camp if they are experiencing any of the following symptoms: fever (38°C / 100.4°F or higher), vomiting, diarrhea, undiagnosed rash, persistent cough, or any symptoms of a contagious illness.
Fun Adventure reserves the right to send a Camper home if they exhibit symptoms of illness during the camp day. You will be contacted and must arrange pickup as soon as possible, and within one (1) hour of notification.
The Camper may return to Camp once they have been symptom-free for at least 24 hours (without the use of symptom-reducing medication) or upon providing a physician’s note clearing them to return.
Fun Adventure staff will not apply or assist the Camper with the application of sunscreen or insect repellent.
Fun Adventure may photograph or video-record campers during camp activities, special events, or field trips.
With parent or guardian consent, these images or videos may be used for promotional, educational, or communication purposes, including on Fun Adventure’s website, social media accounts (including but not limited to Instagram, Facebook, and YouTube), printed brochures, and other marketing materials.
No compensation will be provided for the use of such images or recordings. Participation in Camp is not affected by refusal of photo consent.
Camp photos and videos may also be shared with enrolled Camp families through a private link for viewing and download. Group photos may include multiple Campers and may therefore be visible to other enrolled families who receive access to the same shared folder.
Shared photo links are intended for enrolled Camp families only and are not publicly accessible.
Consent applies to the current Camp season and to future promotional materials unless withdrawn in writing. Consent may be withdrawn at any time by submitting written notice to Fun Adventure. Withdrawal will apply to future use of images but will not require the removal of materials already printed, published, or distributed prior to the withdrawal request.
You agree to comply with all Fun Adventure policies, including but not limited to the Cancellation, Refund & Transfer Policy, Privacy Policy, Nut-Aware Policy, and Code of Conduct.
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
