Terms of Use & Liability Waiver – Fun Adventure

Effective Date: January 1, 2026

Acceptance of Terms

By accessing our website, registering a child, or participating in any program, you agree to be bound by these Terms of Use and Liability Waiver. If registering a minor, you confirm you have legal authority to agree on the child’s behalf.

Assumption of Risk

Camp activities involve inherent risks, including physical activity, outdoor play, group interaction, shared facilities, and transportation for field trips. These risks exist even when reasonable precautions are taken.

Limitation of Liability

To the fullest extent permitted by Ontario law, Fun Adventure shall not be liable for injury, illness, loss, or damage arising from participation in camp activities, except where caused by Fun Adventure’s negligence or willful misconduct.

Medical Authorization

In emergencies where a parent or guardian cannot be reached, Fun Adventure staff are authorized to seek medical treatment. Staff do not administer medication except in emergencies.

Photo & Media Consent

With parent or guardian consent, Fun Adventure may use photos or videos for promotional purposes. No compensation is provided. Participation is not affected by refusal.

Privacy

Personal information is handled in accordance with the Privacy Policy and PIPEDA.

Governing Law

Third-Party Service Providers & Field Trips

Nothing in this section limits or excludes liability where such limitation or exclusion is not permitted by law.

Participation in off-site activities and field trips may involve additional risks, including transportation, weather conditions, environmental factors, and facility-specific hazards. By enrolling a child in Fun Adventure, parents or guardians acknowledge and accept these risks.

To the fullest extent permitted by Ontario law, Fun Adventure is not responsible or liable for injury, loss, damage, or delay arising from the acts or omissions of third-party providers or from conditions at third-party venues, except where such injury, loss, or damage is caused by the negligence or willful misconduct of Fun Adventure.

While Fun Adventure takes reasonable steps to select reputable providers and to supervise campers, these third-party providers operate independently and maintain their own policies, procedures, and safety standards.

Fun Adventure may engage third-party service providers, venues, or organizations to support camp programming, including but not limited to transportation services, conservation areas, recreational facilities, museums, farms, and educational attractions.

These Terms are governed by the laws of the Province of Ontario and applicable federal laws.

Fun Adventure (“we,” “us,” or “our”) is committed to protecting the privacy and confidentiality of personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable privacy laws in Ontario, Canada.

Financial Data

Fun Adventure does not store full credit card or banking information.

Payments are processed securely by third-party payment processors, including Stripe. Fun Adventure has access only to limited transaction details required for administrative and accounting purposes.

Automatically Collected Information

When you visit our website, we may collect information such as IP address, browser or device information, pages visited, and access times for analytics and security purposes.

Social Media and Third-Party Data (If Applicable)

If you interact with Fun Adventure through social media platforms or third-party services, we may receive limited information based on your privacy settings.

5. Third-Party Registration and Payment Platforms

Fun Adventure uses third-party service providers such as Activity Messenger and Stripe to support registration, communication, and payment processing.

Fun Adventure does not sell, trade, or authorize the sale of personal information.

6. Independent Third-Party Privacy Practices

Third-party providers operate under their own privacy policies. Fun Adventure does not control how information is handled once governed by those platforms.

7. Limiting Use, Disclosure, and Retention

Personal information is:

Despite these measures, no method of transmission or storage is completely secure.
